Here's the agreement between you and Wistale. We've kept it as clear as we can — no surprises.

Welcome to Wistale, a product of Devteds LLC ("we," "our," or "us"). By accessing or using the Wistale service, you agree to be bound by these Terms of Service.

1. Service Description

Wistale provides personalized illustrated children's stories tailored to individual child preferences and developmental needs. We offer various subscription plans that let you create personalized stories — including a fresh story every night on our paid plans.

2. User Accounts

To use Wistale, you must create an account with a valid email address and secure password. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Child Profiles and Data

Our service allows you to create profiles for children that include information such as age, interests, and learning preferences. You acknowledge that you have the legal right to provide this information about any child for whom you create a profile. This information is used solely to personalize story content and is subject to our Privacy Policy.

4. Subscription and Billing

Wistale offers various subscription plans, including a free tier with limited features. Paid subscriptions automatically renew until canceled. You authorize us to charge your payment method for all applicable fees. All payments are non-refundable except as required by law. We reserve the right to change our pricing terms at any time, with advance notice provided to users.

5. Intellectual Property

All content generated through our service, including stories and illustrations, is provided for your personal, non-commercial use. Devteds LLC retains ownership of the underlying technology, algorithms, and design elements of the service. You may not reproduce, distribute, or create derivative works based on our service or content without express written permission.

5A. AI-Generated Content, Story Reuse & Fair Use

Output is not unique. Stories and illustrations are produced by artificial intelligence from the details you provide. Because of how these models work, the content you receive is not guaranteed to be unique, and similar requests — from you or from other families — may produce similar or, in some cases, substantially the same results. We do not grant you exclusive rights to any generated story or image, and other users may receive comparable content. You retain the personal, non-commercial use rights described in Section 5.

Story reuse and caching. To keep Wistale fast and affordable, we may serve a previously generated story or illustration that matches your request instead of generating a brand-new one each time. Where this happens it does not change your access to the service or the number of stories available to you under your plan. Stories that include personal details (such as your child's name) are generated for that request and are not served from cache.

Fair use. Our plans are intended for ordinary family use. After very heavy use over a short period, new stories may be generated more slowly or at our standard illustration quality rather than the highest tier. We will always disclose this and will not silently cut off access; any such limits are applied transparently and as a last resort.

6. User Conduct

You agree not to use our service to:

Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Impersonate any person or entity or falsely state your affiliation with a person or entity
Interfere with or disrupt the service or servers connected to the service
Attempt to gain unauthorized access to any part of the service
Use automated means to access or interact with the service

7. Content Moderation

While we employ technologies to ensure appropriate content for children, we cannot guarantee that all generated content will be entirely free from potential issues. You are responsible for reviewing content before sharing it with children and reporting any inappropriate content to us immediately.

8. Termination

We reserve the right to suspend or terminate your access to the service for violations of these Terms, non-payment, or for any other reason at our discretion. You may cancel your subscription at any time through your account settings.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEVTEDS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Devteds LLC and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the service or your violation of these Terms.
